Florida Traumatic Brain Injuries

Traumatic brain injuries (TBIs) can happen in countless different ways, from car accidents to falls. They can be categorized as relatively mild or severe, but every TBI can affect the sufferer and their family in profound ways. If you have sustained a TBI due to the negligence of another person, you may be able to seek compensation for the harm you have suffered.

Too Many TBIs

Data collated by the Florida Department of Health shows that approximately 3,850 fatalities in 2014 were related to TBIs, meaning that while the ultimate cause of death might not have been the TBI directly, it played a role. The highest percentage of victims were male and white, both in terms of non-fatal hospitalizations and TBI-related deaths. These numbers may not seem like very much, but each person who sustains a TBI has a different experience that requires individualized care and compensation.

In addition, the numbers are likely higher, because there are many people who do not seek medical treatment for a TBI, at least not immediately, because symptoms of “mild” TBIs can be relatively innocuous, and in some cases, can be explained by other conditions. It is all too easy for a medical professional to misdiagnose a TBI because either they are simply trying to treat the visible symptoms, or because the symptoms displayed are largely invisible. If you believe that you have sustained a TBI, do not allow a doctor or insurer to convince you otherwise.

Bringing Suit

If you have been injured, it can sometimes feel hopeless trying to seek compensation, because so many people – even professionals – either do not understand your situation, or may believe that you are faking or otherwise malingering for attention or other gain. In some situations, it may also be impossible or very difficult to bring suit – for example, bringing a suit in medical malpractice can be quite difficult, and too many people make mistakes like neglecting to provide presuit notice to the defendant.

However, it is not impossible to file suit and seek redress for your TBI, especially if you enlist an experienced attorney. A good attorney knows how to counter some of the misinformation that is often heard, such as alleging that one needs to be knocked unconscious in order to have a TBI (this is untrue; TBIs can occur with any hit to the head that lands in the right place). If someone else caused your TBI through their own negligence, do not allow your insurer to propagate myths – speak up for your rights.
