Bicycle Accidents In Florida

BikeAccident10

Florida’s beautiful weather even in winter means that bicyclists are nearly always on the state’s roads. Because one can bicycle year-round in Florida, the state’s statistics on bicycle accidents are higher than one might expect, but Florida also lacks significant pedestrian and bicycle infrastructure, playing a role in that high amount of crashes. If you have been injured in a bicycle accident in Florida, you may be able to seek damages for the harm you have suffered.

Injury/Fatality Rate Is High

Preliminary data from the Florida Department of Highway Safety & Motor Vehicles (FLHSMV) estimates around 6,500 bicycle crashes in Florida in 2025 so far, with 123 fatalities as of this writing. This may not seem like many, but it puts the state on track for a higher total than the last three years if the pace continues.

There are several different reasons why this might be the case, but a lack of infrastructure is among them. The urban planning think tank Smart Growth America, in their annual report on pedestrian safety, found that in 2024, 8 of the 20 most dangerous metropolitan areas for pedestrians were in Florida, and in years past, most of the top 10 had been Floridian. In addition, many drivers are simply not aware of bicyclists, despite state laws requiring them to ride on the road, with the flow of traffic.

Be Aware Of Your Own Fault

If you have been involved in a bicycle accident, and you suspect negligence on the part of the driver who struck you, you have the right to seek damages if your injuries are severe. Florida is a no-fault state when it comes to auto insurance, meaning that every Florida driver is required to carry personal injury protection insurance (PIP). This coverage can be used if you are in an accident and your injuries are minor, even if you were not in your vehicle when it occurred.

Keep in mind that even if you are found to be partially liable for your own injuries, you can still recover damages for things like medical bills and pain and suffering – if you are found less than 50 percent at fault. Florida’s law of comparative fault holds that if you are found more than 50 percent at fault for your own injuries, you may not recover damages at all.
